Our assn. is an HOA and we have family and Condos. The Condos units each have their own Assn, Management company and documents. We are the Master Assn I guess. Our discussion centered on hierarchy of documents. The master declaration(HOA) states that in addition to the condo documents, they are obligated to adhere to the HOA documents, What puzzles us is that the HOA docs and the Condo docs are diametrically opposed in many instances,, (in Addition, each of the Condo Associations have differences.) How is this resolved.

I'm president of a master association that contains a condo association, single family homes and town homes. Stay out of the condo board's business and defer to its covenants and by-laws on matters of "condo family business." You should address matters before the master association that affect your sub-communities as a group as well as common amenities and property that ALL dues payers support, regardless of condo or single family home account status.

My master association's by-laws contain different rules as well....we can't chase a post-foreclosed home owner for unpaid dues, we take an automatic write-off. The condo board's rules allow it chase foreclosed former owners for uncollected dues, regardless of a bank foreclosure's "cleansing" of all liens.
