Our community is in the middle of a recall effort to recall the entire board. At the meeting to count the votes, we expect that we will not hit quorum. However, our bylaws state that quorum would be automatically reduced if the meeting is temporarily adjourned for 5-30 days. With the quorum reduction, we believe we would have enough votes to recall the board.

Two questions:

1) Once the Inspector of Ballots announces that there is no quorum, who can make the motion to temporarily adjourn? Since this is a special meeting of the members, can a homeowner in attendance make the motion? (What we don't want to happen is to have a board member simply motion to adjourn permanently and end the recall effort.)

2) I believe I have read previously that because this is a meeting of the members, any motion would be voted on by all of those in attendance, not just the board. Is that correct?

Would welcome any info as well as any supporting documentation, if available. Thank you in advance for any help.

Have no experience with recalls, but aren't they like other elections where the (CA) absentee ballots count towards quorum?

What % of voters in your HOA are needed for quorum? What % for the recall to be successful?

Have you looked at davis-stirling.com for info--. it's a great source of info for CA folks. Gotta go!
