Hi,

Trying to form a HOA in LA, can not find the laws or rules we must follow by the state of Louisiana.

Where do we find these?

Have done web searchs but all I find it this:

R.S. 9:1141.1

but it has no information.

Thanks for your help?

See LA State Laws from HOA-USA website.

See Louisiana page of the Community Associations Network website (a sponsor of this site).

Also stop looking outside your HOA. 99% of the issues you need resolved lays in your own very documents and NOT state legislature. (Look at Florida's mess to see what happens when that occurs). If you don't have a copy of your rules go to the county court house and get a copy of your CC&R's. The by-laws may or may not be on file there. They aren't required to be. The Articles of Incorporation would be on the sites that Tim suggested. If you have an ACC then the HOA may have that.

Oops. I noticed that the links to the statutes from the HOA-USA page were bad.

Here are good links:

Louisiana Statutes Title 9

Scroll down to 9:1121.101-117 for Condominium Association Laws
Scroll down to 9:1141.1 - 1141.9 for Homeowners Association Laws
Scroll down to 9:1131.1 - 1131.30 for Time Share laws

If your planning on incorporating (most do) as a nonprofit, see:

Melissa,

I took the question to indicate that the OP is attempting to start-up an Association (I expect) from scratch.
Therefore, he wanted to know what laws were applicable.

Your right Tim, I missed that part. To help out with the forms you can find them at Office Max, Staples, or office supply stores. They are in the area of Do it yourself rental agreements or for sale by owner. However, those are not high in the demand documents so you may have to look for them online on their website. They don't have all of the forms but you can get maybe the incorporation one. They are about 20 bucks a piece and come with a CD.

where do you live in louisiana? if in baton rouge or new orleans call the bar association office and ask for the name of an attorney who is proficient in setting up a nonprofit hoa corporation. if you are in another area of the state, check to see if there are any other hoa's in your area and contact the board president for information. good luck jmi
