Have any of you who belong to a Florida HOA amended your by-laws and covenants to coincide with the Florida Chapter 720 Statutes of 2004?

Jack: If the only reason you want to amend your documents is to conform to the Florida Statutes, you don't have to. The Florida statutes take precedence over your documents.In order to amend your documents, you have to submit the changes to all homeowners for their approval. Usually you need 2/3 of homeowners to approve the changes.They can't dissapprove anything in the Florida Statutes so this is not necessary. I live in South Florida...

Barbara is correct. If you were to amend your documents everytime
the state changes its laws you would never be able to keep up with it.
The percentage to amend your documents could be a majority or two-thirds, etc.
Just get a current copy of FS 617 AND FS 720 and you should be ok. DorothyH
