Is anyone aware of problems amending HOA by-laws to include criminal (felony) background checks for prospective new owners or tenants in Florida? SG

You could try to amend the CC&Rs to require background checks but why do it? How would the HOA use the information?

I do believe that in Florida you are NOT ALLOWED to use anything you happen to find by doing a criminal background check...The only thing that can be held against someone is if they are a sexual predator or sexual offender-- I think-----And that info is free on the FDLE website...........Just because someone may have felony in their past is no reason for you or anyone else to know about it...Or hold it against them....I am sure I could run a background check on every one of my BOD Members and find some skeletons in their closets......Have you ever heard of libel and slander ?????? Look it up or have your HOA Attorney explain the legal ramification to you....Florida has a new law coming into effect on July o1.2007 which will bar HOA'S from running credit checks on persons....... And just for hoots and giggles who in your HOA came up with this hair brained idea ??? Just curious...LindaC
