We have a hostile board member who "doesn't care what the place looks " Does not understand that the main function of the BOD is to maitain the up keep of the property. What can we do? do?.

Organize a recall petition and vote that person off of the Board.
OR
Wait until the next election and simply don't re-elect them.

If you're on the Board, Decisions are made by majority vote. Therefore, one person voting against everything shouldn't be able to prevent things from happening.

I would take the "You can't win them all" approach. Why focus such energy (attention) to one person's opinion that is mostly wrong? Just be respectful, let them have their say/vote, and then out vote them. Majority rules and if their in the minority they won't win.

You can't change people's minds on HOA's very often until they find out the hard way or by experience. There is a bit of truth in his perception. A HOA does NOT keep the home values up for any home. Never has never will. What a HOA does do is keep the ATTRACTIVENESS of the property to bring in potential buyers. The nicer an area and home is kept, the more likely one is to buy. Home values are based on the size of the homes (EX 2bd 2ba), location, sales and foreclosure prices of properties that have sold within a few mile radius in the last 6 months. Having it in a HOA is only a sales tactic.

So your hostile board member may have the right idea but wrong approach...

I have to leave the forum before you've answered my querie. My advice to your posted question "What can we do?" depends on who "we" is.

If you are not on the Board, there are ways you can get the other owners together (at least 5%) to call an election to oust this guy if he is that unpopular, but I would suspect that you are just complaining for yourself or a few others. If you are a Director asking this question, you haven't yet studied your own governing docs. or Davis Sterling. You must do that.

Carol is also familiar with laws in CA and others can help you as well, but as always, what can be done (or IF anything will even be attempted) depends upon just how many owners are dissatisfied and to what extent.

That's the best I can offer without further info.
