Q: Isn't one of the Board's greatest responsibiities is to ensure the safety and quality of the neighborhood/community? The Board recently did a walkthrough with the developer, and advised the developer of already crumbling concrete holding up homeowner's properties (block concrete at least 5 ft in height). The Board's response to me was, it's on the homeowner's properties, it is now the homeowner's issue. Is this a viable answer? Shouldn't the Board help protect the homeowner? Our community is just turning a year old. Any thoughts?

Todd, if these are individual lots and it is on the homeowner's property it is the homeowner's responsibility. Your claim is with the Developer. It is good to make the Board aware of the problem as it may affect other homes as well. The Board may chose to get involved to support the howeowners; particularly if the Developer refuses to correct the problems.

Hi Roger,
Yes, these are individual lots, about 10, in fact. These homes back a trail that many other non-homeowners use to walk their dog or that kids play, etc. Not only did the developer/builder not build a quality and/or safe product, I'm worried that when these properties settle, things are only going to get worse. In fact, the homeowners were unaware that this was "considered" their property. Shouldn't they be required to do this regardless???
