Can members of the Board delay a recall petition by resigning and appointing new members? Florida requires the listing of a member of the BOD and the replacement canidate. ISTM, that this tatic would result in us having to revisit many homeowners.

James, if the Board members resign who are specifically named in the recall petition there would no longer need to be a meeting. However, if the recall petition calls for consideration of removal and replacement of each individual Board member (no names) then it does not delay the special meeting of the homeowners for the purposes listed in the petition. In that case each Board member can be considered separately including the newly appointed Board members.

Yes, the BOD is elected by the homeowners, 20% must vote to have an election.

Florida's form specifies that the members be listed with replacements. CO sounds to be easier to recall a Board.

For anything that is legally-binding, I suggest hiring an attorney.
