Our Association was turned over to the members from the developer in April, 2004. I have suggested that too many references to the "Declarant", the developer, remain in our documents and he has still used them to his benefit with BOD approval. Would it be a good idea to expunge any developer references from our documents? What's the norm here?

Ours have not had that change made and they were written in 1989.

It would be nice to rewrite all the documents but there is a lot of legal expense involved and it would take a 75% vote of property owners to approve new documents. Most would likely see no point in it and others would be suspicious that the board was trying to put something over on them.

When there is another need to amend the Declaration or the Bylaws it is a good idea to remove obsolete items including Declarant verbage.
