I posted here about 3 weeks ago regarding the issues with our HOA BOD refusing to accomodate a request for my husbands disability.

At the end of the it all... I have proof of denial in both email and text form from our President. Our PM also indicated it was not really discussed or voted upon, yet I got a sounding NO from our HOA President on behalf of the board.

Working together to come to a remedy has taken almost 3 months from the time of original request and 2 indicators stating our request has been denied.

( Please do not ask re-hash what the disability is or whatnot.. this is NOT the issue)

The issues is I have proof of board denial, I have an email from our PM cleary stating it was not voted on and was not part of any minutes, yet the HOA Prez clearly sent a denial to me.

I have consulted the FHA/ADA and HOA know this. They requested to meet with me and my spouse to discuss this in a private forum. This invitation was sent to us via certified mail.

The letter also blatantly states this matter was discussed in a November meeting and voted on.. it was not according to our PM and the timeliness of my denial. My original denial was sent via email 2 weeks before the "the Novemeber meeting" in which it "was voted on" but our PM clearly states this didn't happen.

Discussing this may be just a nightmare. I have proof of what they did, yet they are denying it. They want to meet to discuss this. I am ready to not even bring this up unless they start with the back peddling.

How does one deal with this?? Meet, try to stay on task and ignore the blatant lies of our board? Just walk in and ask.. are you going to accomodate our request. if not just leave?? and pursue the legal means??

As I advised when you asked this question earlier, agree to meet with them in your attorney's office to discuss the issue OR bring your attorney with you. I would also have your attorney draft your response to their letter.

The Board has now extended an olive branch and are willing to discuss the issue. failure to do so may be seen unfavorably by the court (if it goes that far). So see them but on your terms, with your attorney and preferably in your attorney's office.

I am not willing to pay my atty $350/hr for this type of meeting. This is the standard rate for such a service. Seriously.
However, I am going to go meet with them... but just needed an idea on how deal with this at this meeting. I am willing to just walk out after we ask if our request is going to be met or not. it's a yes or no answer.

But I can see the board of course is defensive... after all they not only broke the law,now they are back pedaling.

Life is not black or white, yes or no. Everything is negotiable. Meet with them and listen to what they have to offer. If you don't like it, simply walk away. If you refuse to talk to them, how do you expect to solve anything.

Bring your documentation with you.
Have enough copies for everyone at the board.
DON'T GET DRAWN IN TO TANGENT CONVERSATIONS, i.e. stick to the topic of where to place a lock box
Insist an any agreements to be in writing.
Follow-up the meeting with e-mail stating what you understood occurred and promises offered
