How do we get a copy of our HOA from the state

WE live in a subdivision that has 6 lots. 4 with houses 2 with out. No one has a copy of the bylaws that was filed with the state of South Carolina. We need to get a copy. How do we do that?

If you're talking deed restrictions, you should be able to visit the county court house or land records office and obtain a copy.

The requirement to file Bylaws vary from state to state. If they are filed, they are typically filed with the State Corporation Commission. Try their (South Carolina) "Search Business Filings" page.

As said, Bylaws do not have to be filed with the Covenants (Deed Restrictions). If they are, such as ours are, they show up as an Exhibit to the filed Covenants.

In SC the Covenants are filed with the County Register Of Deeds (ROD).

Start a search on......your association name, so and so county.

Go to the county court house, ask the county clerk for your association's governing documents. They will be able to give you precise instructions on what you need to do.
