This past year there was a class action filed against many Arizona HOA Management Companies. The suit alleges that these Community Association Management Companies (β€œCAMs”), have violated Arizona law by contracting with HOAs in collecting past due homeowner assessments. The suit also alleges that many of these CAMs acting as third party debt collectors have engaged in unlawful activities in their attempts to collect past due assessments from Arizona homeowners.

The reason for posting this letter is to share with many local HOA members in the Phoenix, Arizona area information about our own HOA. I was the first President of the HOA upon the handoff of the association by the builder. All of the contracts for management, maintenance, landscaping, etc., were in place. After a short 2 years we found ourselves in serious financial problems. After performing some research, our board of directors determined that there was some inconsistencies with the monthly reports and what the association was spending. It was further determined that our association management company was overcharging our HOA to the point of almost forcing it into bankruptcy.

It was at that time when our board of directors conducted a search to find a new association management company. It was the best move that we could make. The new management company brought our association from near bankruptcy to having the reserves that are needed but also hiring contractors and vendors that have not overcharged the HOA.

Our community has never looked and run better than it is today. I shared this with you as the previous management company is one of those mentioned in the class action suit.

Do you have more information on this lawsuit, such as case number, names of parties, disposition?

I never thought about it before but for a management company to act as a bill collector it must be licensed as such by the Arizona Department of Financial Institutions. If the management company sends out a notice that your assessment is now due it is merely acting as the HOA's business manager but if it sends out a late notice or any threats of legal action it is operating as a collection agency.
