Our self-managed HOA is in FL and we have people who are complaining that there are numerous violations in the community. The thing is that no homeowner wants to report their neighbor for fear of retribution because of the Sunshine Laws which says that the identity of the complaining homeowner can be released to the violator. No anonymous complaints can be taken for this reason.
1) So, does that make the actual Board of Directors responsible for turning in violators?
2) Is the Board guilty are not performing their fiduciary duty if they let violations continue even if no one reports them?
3) Does the Board have to make the actual complaint and sign it with a homeowner's name or can it just come from the Board?
4) Should the Board appoint a Neigborhood Review Committee to do regular walk throughs of the neighborhood and report them to the Complaint Committee?
5) If it is the Board's job to uphold and enforce the CC&R's, do they need to make sure all violations-even unreported ones-are eventually corrected?
