I don't see why not.
However, it should be noted in the minutes of that meeting.

The board, acting as a body, can invite anyone it wishes to attend a board meeting. (No single member can invite a non-member to attend. The board must vote to allow the person to attend). The person does not have to be on the agenda, but their attendance as a guest should be noted in the minutes. The non-member cannot speak unless asked to, nor can they make motions, participate in debate, or vote.

Since agendas for board meetings must be posted 4 days before the meeting in CA, I'd say that if the attorney has been invited for an agenda item-related reason, s/he should be listed on the agenda.

In our HOA, I'd place the name on the agenda just to try to get more Members to attend! Why would anyone not want the HOA attorney's name on the agenda?
