I sent this out to inform fellow owners of the upcoming meeting:

If anyone is interested in being on the Board we ask you to complete the enclosed/attached “Candidate Form for Board of Directors”.

The candidates will then be voted on at the annual meeting. Those candidates that are successful will be asked to make themselves available for as many meetings as possible and to be reliable when required to help the board.

*NOTE:

1. NOT LESS THAN 40 DAYS PRIOR TO THE ELECTION, CANDIDATES MUST GIVE THE ASSOCIATION WRITTEN NOTICE OF THEIR INTENT TO RUN FOR THE BOARD. (can be “Candidate Form for Board of Directors”)

2. THOSE CANDIDATES WHO WISH TO SUBMIT A CANDIDATE INFORMATION SHEET MUST PROVIDE IT TO THE ASSOCIATION NOT LESS THAN 35 DAYS PRIOR TO THE ELECTION. (Not required if the “Candidate Form for Board of Directors” was completed in step 1)

The president countered with the following e-mail:

To All: By-laws state we have 2 methods of being elected to the board. 1) With a 60 day notice

and a written resume and a paragraph on why you want to be on the board. 2) Can be elected at the Annual Meeting.

The majority of the board want to keep the election process as simple as possible and not have to write a resume or paragraphs.

Please disregard any and all other notices:

This is the process we will use for the coming election at the Annual Meeting on Feb. 17, 2013:

Every one (including the current board members) who is interested in serving on the board (term is one year) must notify in writing the Board Secretary not later than Jan. 13, 2013 (30 days) prior to the annual Meeting to be held on Feb.17, 2013. That will give the board time to generate the paper work and or ballots if required. At the Annual Meeting we have the election and talk about the process and change(s) to the By-Laws if required.

SO IF THERE ARE NEW PEOPLE WHO DO NOT KNOW THE OTHER OWNERS RUNNING ON THE BOARD HOW WILL THE VOTERS KNOW ANYTHING ABOUT HIM?

ANY SUGGESTIONS ON THIS ONE WOULD BE APPRECIATED.

You said you sent the following out. Who are you to be sending out information dictating how the election will be held?

Most associations do allow for nominations from the floor at the time of the meeting. You all had better check on this.

John, Jill was following the procedures outlined in FL 718.112 (4a). Jill however should not have arbitrarily sent it out without the Boards approval.

I am a member of our board and was tasked with the election of new and old board members. I also helped the secretary with the notification and it was sent out under her name. Prior to it being sent out it was sent to all board members for their review and comment. Only one responded and that was positive. There was a time frame set so when the date arrived it was sent out.
Maybe I am not understanding the Bylaws both Fla and our own but I can't see where one excludes the other. I believe you follow the process as outlined in my communique and if there are more vacancies than people who indicated interest then they can be nominated from the floor at the meeting. Am I wrong?

I don't live in florida, but someone else pointed out that you followed state law and what you sent seemed reasonable to me. I understand wanting to keep the process simple, but I don't see anything wrong with someone talking about his/her background and why he/she wants to serve.

Our association's process is pretty simple:

When we send out the annual meeting notice, homeowners are told who's up for re-election and what the qualifications are (you have to be current in all fees and listed as a homeowner on the Association's roster {which is based on who's listed on the deed})

Homeowners can nominate themselves or someone else to run against the board member(s) up for re-election or a vacant spot, if available. We tell interested people to attend the meeting and be prepared to talk a little about their background and why they want to serve.
