Hello. Our BOD holds CLOSED meetings monthly and does not issue minutes, despite rules that say they have to in 30 days. Most of the residents are too old or too stupid to care, but I do....any recourse??

Wow...too old or too stupid? Let me elect you to the board to represent me...You don't say if they have any OPEN meetings just closed ones. A board may have private meetings to get things in a row before going into a public meetings. So don't know if that is happening from your post.

The meetings don't sound too top secret if you know they happen. Like the other posters will say...If you want the job go for it. I would just lay off with the stupid and old comments about your neighbors to get you there...

they are supposed to announce the monthly meetings, solicit resident input, then send minutes out. The builder is still on the board as the community is not finished. we only know about the meetings because we see wee the cars at the office every month. i think the homeowners who are on the board ar in the builder's pocket

Thats information we need to know...Your still under builder control. You and your neighbors won't have much say until it is turned over. Do you realize when you become a board member people are going to say your in the Presidents pocket and friends?

Stop with the paranoi and concentrate on reality. That is what you are all going to do when the HOa gets in you and your neighbors hands?

It's NOT what you want but what the developer wants. It's still their property to manage. Letting a few people from the neighborhood/HOA members on the board is just courtesy for the most part at this time. Those members are there to represent the HOA as just owners at this point. Once the transition happens it will be ALL owners/members and what you ALL want as owners.

Yeah it would be nice to have an open meeting, meeting notes, or an email once and awhile. However, that's not going to happen unless something happens. So I recommend sitting back, relaxing until they throw that angry cat of an HOA onto your bare lap...

Once again we have a poster who comes to this site with what seems to be limited understanding of what is required versus how they think things should be handled. Is there in fact an open meeting required under PA. state law? I don't know but in NY there is no such requirement. Perhaps the OP should take the time to find out.

As to responding by e-mail I doubt many properties would take on the job of responding to e0mails that make demands not required of the HOA or Board.

And the stupid and old comment IMO not the way to gain support as many if not most folks you degrade just might not wish to asist you in anything.

Yes again we get the "this is how I think it should be done." "I think the Board should _______." "I think without having any real understanding I know more than anyone else." "And if you don't agree you must be old, stupid, or both."

hey, chill, will ya? the old and stupid was tongue in cheek. besides, I'm old and stupid anyway. the problem as it exists is that we have 3 board members from the builder, 2 from residents. the community is upset with the builder for various reasons, but the 2 board members drink the kool-aid. they are keeping things secret. they are supposed to have monthly board meetings and issue minutes within 30 days. they have the meetings, but don;t issue minutes, that's all

My suggestion . . . read your declaration and by-laws carefully and completely. These docs provide the "instructions" that the HOA, Board, and Members are to comply with. You stated that the "rules" say the BOD is to issue minutes in 30 days. I assume you found that in the declaration or by-laws somewhere. If so, please provide the exact verbiage to this forum and people here can be of more assistance.

Also, "rules" are established by PA State HOA Law, the Uniformed Planned Community Act or Uniform Condominium Act. Just do a search online and you can find them.

Assuming the Uniform Planned Community Act is applicable to you . . . per PA law, only one "meeting of the association" is required per year. This means that the BOD can meet wherever and whenever they decide to meet and not extend the invitation to homeowners . . . which I suppose would make them closed meetings.

That being said, if you properly request minutes from those meetings (IAW what your docs say), then you should be entitled to receive those minutes. However, as people on this forum have already pointed out . . . you'll probably get a much better reaction from the Board, Developer, and Management Company (if applicable) if you politely and properly make your requests instead of making demands.

The OP insults his neighbors and fellow owners as "old and stupid".

Then based on less than nothing other than their percieved failure to abide by the OP standards of what is right and necessary the OP goes on to label the Board members as "bozos" and then throws in their theory the Board members "might be on the take".

Now as a Board member myself, who as most do, volunteer my time to manage the affairs of the OP's property it would be difficult if not impossible for me to have any interest in dealing with the OP or considering their joining the Board.

When you know little and seem to understand less isn't it or shouldn't it be tough to find fault with the behavior of others? Or insult them and their ability to do their jobs and even question their honesty? In my world it would be.

YES, the OP should be running the show no doubt at least in their view. I would wonder if anyone else shared that opinion?

it is a 172 unit property that was started just as things went south in the market. the project is in a forebearance agreement now, and the banks control the money. We were promised a clubouse after 1/2 the homes were sold, that happened a year ago. we dont think it will ever happen, and the builder is evasive

This for me is one of the interesting aspects of sites like this. Rather than people watching you get to people listen. And with time most people show you what they are and level at which they operate at.

Now I COULD come back and sink to the simpleminded level of McGrath and insult the entire population of Pa. Truthfully though I can not do so for several reasons. My guess McGrath bought a piece of property that today is worth less than what he will pay for it over time with principle and interest. My guess looking back buying into this development was a BIG mistake because of the market crashing and the financial difficulties of he builder. My guess McGrath is not a happy camper and being unable to comprehend that some of this might have been no ones fault and some just might be his own fault, he chooses to blame everyone else.

Is it hard to figure out why people might not respond to his e-mails. Is it hard to understand why someone might not want him serving on the property's Board? Is it hard to put together why this Board might choose to hold private meetings? Is it hard to come to the conclusion that McGrath is at least a part of the problem? With his kind and thoughtful desposition and all.

I find it entertaining when small minds try to use their words in insulting people. Try, try, try as they might to muster together some meaningful display of their knowledge of the English language in an aggressive form they fail.
