Our Board, has decided to remove the covered parking that some of us bought our property with, because it bothers those that their unit windows are under the covered area?
Now the problem is that the covered parking was build 30 years ago, and is not recorded anywhere in the documents? So my question is have you ever heard of a similar case? And really we all believe is retaliation against some of the owners that have covered parking.

Is the covered parking on your deed? In our high rise HOA there's underground parking and each space is deeded to an Owner.

Are you saying that some units' windows look out into a covered parking area? With the "cover" above the window? I'm trying to "see" the situation.

How many units are in your HOA? Detached homes, or? How many have a covered parking spot?

Not knowing exactly how your CC&R's are worded, the Board probably has the right to modify the property unless the parking areas are deeded to individual homeowners. Either way you should contact an attorney or you may come home to fait accompli.

I checked, the parking spots are deeded, but makes no mention of covered, so it would fall under improvements I would think and three units windows overlook the parking so yes the cars park outside their window that won't change if covered or not? It happens they purchased their units like that?
