In a condo complex where garages and car ports are NOT attached. Assume Mr. Abe owns a condo. Mr. Abe has either a condo or a car port DEEDED to him along with the condo that he occupies and again, assuming that Mr. Abe is the deeded owner of the condo. Can Mr. Abe rent out (to another owner or tenant from within the condo complex)either his unattached garage that is part of his deeed.... or rent out his car port which is part of his property and properly deeded to him. We are presently in a squabble when one or two individuals INSIST that it is against the law for Mr. Abe to rent to another owner/tenant his garage or car port..... Any comments?

Unless it is prohibited by your CC&R's, then yes he can rent them out. As to the ones insisting that it is illegal, ask them to show the Board where it is illegal.

I agree. In one HOA I lived in that had single car garages, there was an active market in renting out ones garage during the winter if one was a snowbird and went south.

I know someone that rented their garage Nov 1 to April 1 (to me) and when they came back for Xmas, they parked in our general, open lot parking area.

We have 3 levels of secured underground parking spaces that are exclusive use common area and that are deeded to units. Our CC&Rs permit us to rent out the spaces to residents only. If the space tenant violates our rules (e.g., allows fluid leaks; stores items in the space) the owner would be sent a courtesy letter and then called to hearing if the violation wasn't cured using the same procedure for calling owners to hearing for violations concerning their condo.

In our urban neighborhood with very limited and expensive off site parking, and with 211 condos and 298 spaces, space rentals are very common. In fact, because we can walk to so many services, many condos with 2 occupants & 2 spaces, often eventually find they need only have one car. They either keep their 2nd space for guests (though we, unlike most of condos around us, have 16 underground guest parking spaces), or they rent them out.

So, Alex, as with Glen, if there's nothing in your governing documents prohibiting such rentals, I don't see why those two think it's illegal, or why they should be concerned! I do think it's a good idea to have a few rules about them, or make it clear that those who rent spaces must follow the same rules as those who keep their spaces for themselves.
