I once saw a suggested statement that wise HOA boards should place in their CC&Rs that says something like "just because we didn't enforce a covenent before doesn't mean we no longer have the power to enfore it in the future." Does anyone have the exact wording (or close) so we can make use of it? Tks.

This is cut-and-paste from another thread on this forum:

"Failure by Developer or any Owner to enforce any covenant or restriction herein contained shall in no event be deemed a waiver of the right to do so thereafter."

Waiver. No covenants, restrictions, conditions, obligations or provisions contained in this Declaration shall be deemed to have been abrogated or waived by reason of any failure to enforce the same, irrespective of the number of violations or breaches which may occur.
