Got a question, and the ByLaws do not cover it, so I thought I would put it out here to see where it stands at.

After the annual meeting, the first meeting of the trustees is when the BOD members are nominated to the positions as President, Vice-President, Etc. My question is this, If a member of the BOD nominates another BOD individual, can that person second that nomination? Or is that person being nominated not allowed to speak during the process?

The state would be Colorado, if that makes a difference.

Randy, for a small group, such as the Board of Directors, a second is not necessary if you follow Robert's Rules of Order. The Chair can (and it may be desirable to) allow nominees, and any other Board members, who wish to speak, to do so prior to voting for each office.

You are so correct. Where the issue is, is some seem to feel that "Robert's Rules of Order" are the governing documents for the HOA, when they are in fact nothing more then for reference and suggestive. I agree with the rules in how it should flow, but they are not the ByLaws of such.
I think that's where the confusion of others comes about.

Randy, you are correct. Robert's Rules only apply when other rules do not specify the particular action required AND they are part of the By-laws. When neither is present in the By-laws, most organizations usually follow Robert's Rules. However, when neither are present the Board will do whatever the majority chose.
