Our homeowners association operating rules and common facilities use policy has a section that defines the hours of useage of tennis courts as DAYLIGHT HOURS. Our section on useage restriction further defines the hours of useage as between 7 AM to 10 PM. The useage restriction section further states the time during which the tennis courts may be used may be further limited or extended by the Board. The residents have circulated a petition to change the hours of useage to start at 8 AM. They have obtained 55 signaturews out of 80 permissible.

My question is: Can the board vote to deny this petition?

yes they can, the board sets rules and regulations. However, considering 69% of the permissible voters have expressed an interest in this the board should listen to what the membership wants unless they have a good reason not to

I agree with Brad. While I believe the BOD could set the hours, the BOD would be foolish not to "listen" to what the majority of owners want, especially when you can prove what they want.

That said, one could argue that DAYLIGHT is sunrise to sunset.

A personal aside. The 8am restriction sounds like a bunch of old farts trying to limit younger, earlier risers fun. I could be wrong......LOL

As was previously posted, yes the board could consider the petition and refuse to make any changes.

Of course, with 55 out of 80, it appears that if the Board does this, there is enough support to recall the board and elect new board members who will change the rules.
