I'm sorry you were injured.
Based on what you provided, I don't see how the Association would be responsible (even remotely).

Change the location, you were crossing the street in a crosswalk and was hit by an automobile, hit and run - is the City liable? What about the stores on either side of the street? What about the other vehicles who didn't hit you?

You were involved in an accident. Expecting that you looked both ways before crossing the road to go to the mailbox, the person who is responsible is the driver of the vehicle who hit you.

I hope you contacted the police and reported the incident.
I hope that any injures will heal quickly.

Were you on community property?. Who owns the roads - the County or the HOA? Was it daytime or night - was it properly lit? Were you in the street? Why would your neighbors(the HOA) be at fault and get sued?
Who caused the accident? I am just delving into the situation.

Sorry - Tim and I must have been typing at the same time. Maybe, you could call your insurance company to find if your state has a no-fault coverage for your injuries.

Most likely, no. You might have a good case against the driver of the automobile, though.

Let us say I own a business which includes a parking lot. Now someone is walking in my parking lot and they get hit by a car.

I would think that unless one can prove negligence on my part (the lot owner) it is not my issue.

Of course I assure you there are some scumbag lawyers that would take the case and my insurance company would believe it cheaper to settle out of court so several Aholes would make money.......LOL

Hi, were you on community property of the HOA? I'd check with the insurance of your HOA because in some homeowner's insurance there's a no-fault coverage clause.

Sorry to hear about the hit-and-run. I had a car accident with a hit-and-run driver and I only hope that karma catches up with them.
