Does anyone have a website to point me too regarding starting an HOA in Georgia. We are an older neighborhood, over 25 years old, that has never had an HOA. Currently there is interest in the neighborhood on starting one. I've dug through Gwinnett County and state regulations and cannot find any reference material. Thanks for the help!

Try looking through any deed restrictions or CC&R's you have, to see if there is an option there for people to start their own; if so, the procedure might be laid out. Otherwise, I would suggest that you contact a lawyer who specializes in HOA law in Georgia.

There are three law firms listed on the CAI-Georgia chapter website; check them out at http://www.cai-georgia.org/

James,

Our association is in east Cherokee county and we use Weissman, Nowak, Curry and Wilco. We really like them for a number of reasons. I believe their website is www.wncwlaw.com. They have a number of offices throughout the Atlanta area. Also, I would recommend a POA over an HOA in Georgia, more benefiting to the association. Plenty of HOA's are changing to POA's in GA. If re-elected next week, that will be this year's goal for the board and our association.

Julie
