Our HOA has meeting each and every month at a given place and time. The information is sent
out only by E-mail and from what I have found out no other attempt is made to notify the Home
owners of the meetings.

Looks like the Board members are the only one’s informed. Is it not true that all home owners
are authorized to attend the meeting and be notified by Ground Mail, E-mail or posted on a
bulletin board accessible to all owners so they may attend?

All members are supposed to be notified about the meetings.

Check your CC&R. Ours required written notification by mail or personal deliver. Our state has different requirements (California requires posting a certain number of days in advance in a public place unless an owner requests notification by mail/email).

You have to differentiate between open and closed meetings (general board meetings and executive meetings). Our CC&R and state require that notification include an agenda.

E-mail should be sufficient to announce meetings -- if the HOA has a working e-mail address for all the homeowners.

Do you think that the board is deliberately trying to cut the members out of the process? Or are they just lazy about sending out notices?

It could be trying to save money on printing and postage, but then again the board may be a tad lazy. If the meeting's around the same time every month (e.g. 2nd Tuesday, 6 pm at the clubhouse) they can always post a sign at the clubhouse a few days before the meeting an/or send everyone a schedule of the dates. We publish the dates of the next three meetings in our newsletter and post a sign in front of the clubhouse three days before the meeting

 Your correct on the meeting and that only a small part of it.

I have voiced my concerns in the most up front way and laid the
regulations in front of them, all 5 sections related to Colorado and the
Association. Bottom line they would not acknowledge my concerns,
that is until my wife joined the board. She is a strong lady and has not
asked but demanded accountability, clarity & responsibility as per
Declaration and rules and Colorado law. The responsibility of
contracted labor forces and Etc.

I have taken the time to read the rules and then addressed them in front
of the Board for the past two years.

My wife agrees that the problem is extremely bad, and we work
together. The Denver post has an article titled ( The dark side of HOAs
by Jose Martinez, dated September 6, 2012 page 19A. Denverpost.Com

As for the meetings you are correct, Not one time have I seen the
bulletin board used for information ( I requested one be put up a year
ago) All type of things get posted from the home owners, like - lost
dogs, child care, work request but that all. Never have I seen ANY info
from the Board or M.C. E-mail notification to a few people, but a lot
of older people do not use or can they afford Computers. The
neighbors have reported the same thing. So this week I will confront the
M.C. and Board about this in the most firm way. I will post the place
and time as they will not.

It appears that you are in a catch-22 situation.

Per article § 38-33.3-308 of the CCIOA, members are allowed to attend all regular and special meetings of the board (minus executive sessions). However, the CCIOA only requires notice to the membership of general membership meetings. Therefore, per the CCIOA, you may attend the Board meetings but the Board doesn't have to inform you when they are (however, I could have missed it).

Therefore, unless your Associations governing documents require notification of Board meetings to the membership, it appears that your board is complying with the letter of the law.

So do we first Thursday of the month, 7PM at the clubhouse, except December. Why do you need notice every month?

We had an established meeting date and time as well. No need to notify anyone personally. It was the First Thursday of every month at 7PM. We had it posted on the bulletin board above the mailboxes. If you truly want to participate in your HOA's business your going to make the effort of finding out when the meetings are. Your also going to find out who the board members are to ask them. Have them put you on their email list if that is the way they handle things.

Just because people don't show up to meetings does not mean they aren't notified. You put in the effort in your HOA you want out of it. Apathy is the number 1 reasons HOA's fail. So don't concern yourself about if people attend or don't attend. Just know if they want to attend...they can and are allowed.

OK, good point as to why we need to be informed. For the first
place it was held at the court house, 4 times, then at a small
restaurant, 3 times, Yep, They ask us to leave on the 3nd
meeting. Then at a larger restaurant, then back to a small
restaurant and now at the Fire station. I drove 126 Miles just
to attend a meeting to find out it was canceled and NO
NOTIFICATION. That’s correct, None. An a surprize, one board member was never informed, I sent a E-mail to her. It ā€˜s all due to the president being unable to make board
meeting as she goes to school. Age about 52. It’s always at 08:00
Hrs on Sat. If week days the court house would be happy to do
so.
Trust that will help you understand. You did have a very valid
question and thank you.

Also on the E-mail list? The community is for retired people
and some don’t want or can’t afford a computer and frankly
don’t know how to use it. They have that right and are not
required to have one. For a fact, some can not afford one or the Web access. Law for us will say, E-mail, Ground
Mail, or post it on a bulletin board accessible to all. That’s
clear on the HOA Documents, very clear.

So, Richard, since your wife is on the Board, does she always know when the meetings are? Or was she the one who didn't know about one of them?

If she does always know when & where the meetings are, could she be the one to post the notice on your bulletin board? Or could you (as you've already mentioned)?

Do your Bylaws or some other governing document state anything about notification of open meetings to h'owners?

I'm curious about your HOA--how many homes? It sounds like there's no community room of any kind? Where is the bulletin board located?

This is her 2nd month with the board and as for knowing when the meetings are, she had to call
two times to find out, although one board member request the meeting place with E-mail and I
sent the info.

As for posting the info, I would most happy to do it and will if authorized. As for Bylaws and
Etc. It is very clear on how the info is to be sent, Ground mail, E-mail, Posting on Bulletin
Board or hand delivered to address’s. As for homes, we have about 66. Also we have no place
to hold meeting so we/they do what they can. But then again, as the president wants.

We did hold a meeting today at 08:00 hrs today and the items address would indicate that the ball
may now be rolling and things may change, I sure hope so. I’m firm on the State of Colorado
laws, and all the documentation for the association which has been neglected badly.

The heart and soul of our association will start with that. It is also the foundation to work with
and from. A clear guide to help and assist with our community. Some might say the Bible of our
complex.

This must also be tempered with understand, compassion, firmness & with no favoritism which I might add is prevalent at this time.

At the present time I know of no board member, and I say again, NO BOARD member that has taken
the time to read our document and Colorado Laws. I have 3 times and it’s not easy and I’m no
attorney but most is very clear. I have endeavored to learn as much as I can, but do not trust it to
memory, but to familiarize my self so I can at least look and research info to assist in any
judgment. Not perfect by a long way but trying as best I can.

The only way to change things is to get involved, which it sounds like you have taken that step by the simple fact your wife sits on the board. There is a clear communication break down with your HOA. I would encourage other homeowners that care to step up and be part of the board and change things. That is the only way that things will. If your HOA board is not responsive to your concerns, then I think they need to step aside and let others that are willing to be open and communicative take the positions and run the HOA.
