Hello again,

Sorry to start another topic so soon, but I have a side issue in resolving the truck problem.

Up until I posted here, the primary individual I have been working this problem with is the community representative at the HOA.
I have begun to see him as part of the problem. He is a young man and although pleasant enough, I am not sure he has a through grasp of the mechanics (for lack of a better word) at play here. He also routinely does not return phone calls and emails, even when he says he will, and no I have not been calling/emailing incessantly at all. However, worst the biggest problem is that I have come to believe his main sympathies are with my neighbor and his truck.

Quite by accident I found out he is from the same small town as my neighbor. That by itself is completely irrelevant. But more and more I perceive his sensibilities side with my neighbor's interests more than my own.

What I want to do is contact his supervisor or someone higher at the HOA and complain about him, mainly on the basis of the unreturned phone calls and emails.

My question: is that a wise thing to do?

Sure. Contact his boss if he isnt doing a good job. Write a real letter. Not a email or phone call. People just ignore those.

Who is in control of your association?

Initially it is the declarant/developer/builder with control being turned over to the owners at a later time like when so many units are sold.

Under the declarant they might well have an Owners Advisory Board. Generally they are appointed and powerless when push comes to shove.

If under declarant control, the rep probably works for the declarant or the declarants manager. The declarant can pretty much do as they please which includes make rulings on the truck being in the driveway and ignore you.

Even if under owner control they can make rulings you do not like and ignore you. If under owner control with an elected BOD, you can either try and recall the BOD or some members or get yourself elected.

Under either control, there is another alternative available to you. Hire a lawyer and sue. This is the trickiest and least suggested path to follow.

I think you have to sit down and closely read all your associations documents to best know how to proceed.

If you have other Member neighbors who share your concern I suggest you ask them to co-sign your letter, numbers always seem to help. By all means, if your present contact is not returning calls and is not upholding your governing documents there should be no problem taking it up the chain of command. Suggest you be respectful and courteous and just stick with the facts. You never who is related or connected with who?

If the Association is under membership control, you may want to schedule a meeting with the full Board and politely explain your position.

This request can also be done if the Association is under declarant control but they are more likely to ask you to go through the management company as a declarant control board might only meet once a year.

On your next e-mail, try copying the board when you contact him. This way, everyone will know the issue directly from you. By copying the Board you also don't run the risk of turning the individual against you completely because of complaining about him.

Right at the moment I am working through the Byzantine coils of the property mangagement association to try and get answers to your questions. I called them and asked to speak to our community representative's supervisor. I left a message and hope he will call me back soon.

Well it's 7 PM where I am and no one has contacted me from the management company all day. Is this a top notch outfit or what? Maybe tomorrow!

And I am still in the dark about how to post photos.
