I live in an HOA of 22 units in Los Angeles. I've written here before, am really frustrated with my HOA board, and quit the board in May. I feel the board does little but defer maintenance. Sometime told me that if I was really frustrated and could get twenty percent of the other HOA members to participate I could demand that the board address my concerns. It could work, but fear the board would simply ignore me once again. Does anybody know of this or where this twenty percent idea came from?

From your own CCR's or Bylaws I assume.

Special Membership Meetings
Who May Call a Meeting. As provided for in Corporations Code ยง7510(e), special meetings may be called for any lawful purpose by the following:

Directors. By the board, the chairman of the board, or the president.

Petition. By petition of the membership signed by at least 5% of the members. The right to call a meeting by 5% of the membership cannot be changed or eliminated by contrary provisions in the bylaws. Members are restricted on the purpose of special meeting.

Others. By such other persons as are specified in the bylaws.

This is a way for members to petition a meeting, but it is certainly less than twenty percent of members! Also "members are restricted on the purpose of special meeting. "

evidently 5% can call a 'special meeting' to address a 'specific point'

.05 x 22 = 1.1 ~ therefore you would need 2 signatures on the petition (which should also include the specific purpose of the special meeting)

imo: including the section of Davis Sterling would not hurt

The Special Meeting would be called specifically called to take action, as long as the action to be taken is clearly stated on the petition and the quorum requirement, if any, is achieved.

The other option is calling a town hall meeting. No action can be taken, but there are no other requirements for calling such a meeting.
