I am the VP of a small HOA. (6 units) I moved in 5 months ago to find out one of the neighbors allowed his dog to run off leash and use the grounds just outside my door. My unit is the end and faces the back fence. At one point there were 10 poo piles. I placed pin flags on each so the AC guys would not track that thru my unit, and hopefully bring to the dog owner’s attention the poo piles were being noticed. He picked up after his dog within a week or two. He has since allowed a roommate with a dog to move in. As stated in our bylaws only co-owners are allowed 1 pet.

ā€œPets shall be kept or maintained in or about the Condominium Apartments only if the Co-Owner is granted a conditional license to maintain one (1) pet by the Association. Such a license will be granted subject to the following conditions and reservations:….
G. The Board of Directors may, upon their sole determination, revoke or terminate the above conditional license if a pet is either vicious or is annoying other Co-Owners or occupants or is otherwise a nuisanceā€

At this point how do we go about granting conditional licenses? 2 renters already have 1 dog. They walk their dogs off property. The guy and his roommate consistently walk their dogs off leash. I have been charged and jumped on by this dog. Her dog is male and marks the bushes on the sidewalk outside his unit. We don’t see him marking, but that is the only male on the property and the stains started after she and her dog moved in. This dog has been considered a nuisance.

Can we require immunization records and city licenses? What is our recourse…evict the dog.

For any violations, you should follow the enforcement procedures of your Association.

For your personnel issue with the pet droppings, visit a nursery and ask about dog repellent. I had a similar issue and used a repellent for a few months then never had to again as the dog in question was conditioned not to enter my yard.

Anita - Landscaper's red steel wire flags work great (like you say). Although the idea is ahead of it's time, a lot of large condos and apartments are not requiring Pet registration (It's like $35) and that pays for the DNA registration. Once you register and send the DNA to the processor, you usually will not ever have to pickup the surprise and have it tested. Belive me... It's coming to a neighborhood near you soon.
