What does a small community do (8 units) if no homeowner wants to serve on the board but there are bills to be paid and very little maintenance issues?

Pay a whole bunch extra in assessments to cover the cost of one of the following:

a) Paid property manager
b) Paid management company
c) Paid court appointed receiver
d) Paid Board members

With all the complaints you have posted about your existing Board, I'm surprised that you don't want to serve on it.

Hi, Tim: My husband and I would - however, we are trying to sell. The whole HOA is a mess from the board to the books and no one wants to inherit it. We don't even have records that are compliant with law.

I would think the reason for serving would be to get the association in tip top shape to make it easier to sell...versus moan and groan about the place.

Has your developer caved in and turned control over to the owners or is he still running the show?

The developer back in Oct. 2011 gave control to one of the unit owners - now the president. Not sure how that works exactly, but never has seemed right to me. We've never seen any documents to this effect although I have repeatedly asked for them. The developer said he was tired of the HOA. No one received any notice of control being turned over. We just received an email that said we are having an HOA meeting on Oct. 6, 2011 and I am the president. News to all of us. This is the guy who has misused funds and is threatening other owners to pay up or else! Both the developer and the president are insisting on "releases" from two units saying that we will not sue them for anything they have done. They wouldn't need a release unless they have done something wrong. Misuse of funds, misuse of power and fiduciary responsibility are only the tip of the icerberg here.

Further-we were the first owners in the project and there was never any HOA meeting between Oct. 2008 and Oct. 6, 2011. No budgets sent out, no communication, nothing. We paid our dues to the developer's son (as directed by the developer) until such time as we believed a proper HOA had been established in Oct. 2011.
