We are a new board that took over after the recent elections. The prior board used a management company to run everything and we have since found that some document templates are incomplete or just missing. This is why we are working to get these forms together and up to date. An one of the forms that I am trying to create from scratch is the HOA Estoppel Certificate. I have searched the net and I find lots of forms for requesting an estoppel but nothing really about how the Certificate should look. Any help would be greatly appreciated in finding a template that I could use to get our Association back on the road to having all the necessary document templates.

I would check with the title companies in your area which are preparing the paperwork for deed transfers. I believe that they have specific requirements as to the information they need on the estoppel certificates.

I've never heard of an estoppel certificate from an HOA. I'm the treasurer of our association and have done numerous estoppels over the years. The title company has always provided the estoppel form. I just fill in the blanks. Each title company has their own form. I fax the title company the estoppel and if money is owed I include a W-9 form and a statement with all open invoices, late fees, attorney fees, and if there is a special assessment I also fax our cover letter that was mailed to owners explaining the assessment.

Our property management company provides estoppels for the association. We do not use our attorney as they will only prepare an estoppel based upon the Florida statute safe harbor provision.

The management company uses "Community Archives" which you can find on the internet. They charge a fee of $150 for processing & if someone wants it expedited they add another $150 to the cost. You can certainly use them directly as a homeowners association

Just a clarification - Our management company charges the fee to the person requesting the estoppel.
