The Virginia Administrative Code, COMMON INTEREST COMMUNITY OMBUDSMAN REGULATIONS, has been updated concerning complaint procedures. Each Association should review, modify and/or create their complaint/enforcement regulations to comply.

Here are the specifics:

Common Interest Community Ombudsman Regulations Effective July 1, 2012

VA ยง 55-530. Powers of the Board; Common interest community ombudsman; final adverse decisions.

Association Complaint Form (10/09)

Request for Waiver of Filing Fee (10/09).

Notice of Final Adverse Decision (10/09).

Basically it's a combination of some old and new information. The Association now has to inform the membership that they have a right to complain to the CIC Board of any adverse decision (enforcement process) against them. The CIC Board will then review the complaint and decision and issue a ruling. At least that's how I understand it.

Personally when I read about all the FL this and that statues and Davis-Sterling, I get very nervous about politicians, bureaucrats, judges, and lawyers trying to dictate how things should be operated in an association.

I believe I have the ultimate control. Accept, sue, or move.

Did anyone see the recent 60 minutes interview with Jack Abramoff? He claims his lobby organization controlled the votes of 100 Congressman.

Unfortunately, when your on the Board you have to make sure the documents comply with the law (at least before you move )

Unfortunately most people don't have the money to sue or move and if you have a group of nasty people on the board, accept is not a possibility. Aside from removing the board, states and counties with complaint procedures are all the little guy has to protect him. Which is why we see more and more states and counties going in this direction.

I should have added recall/vote out the BOD. One has to ask themselves if they cannot mount enough support to recall/vote out, etc. then are they really the ones that are correct or are they just the disgruntled minority who believe they are right even when they are if not worng, still in the minority.

Like those that believe they win every battle they ever fought in, but still do not understand how they lost the war.
