Thank you for all of your responses. The toilet was fixed immediately. The wax ring was replaced by my contractor and the leak was gone. It is hard to imagine that the toilet caused that much damage because I barely saw any water around my own toilet. I don't even know if my toilet really caused the problem. I was not given any time to investigate the supposed damage to the OP's ceiling. In fact the OP may have made it all up since she is selling her unit, she may have thought this was an easy way to get her ceiling fixed. BTW the OP and the HOA president are friends and the HOA president is the one who approved the repair deeming it an emergency, which it was not. The OP could have waited even a week for the repair. The exact same scenario happened to my apartment but everybody was sure that the leak came from the apartment above me. The HOA absolutely refused to pay for any damages to my ceiling and I had to wait 2 weeks to get it repaired while the owner upstairs made preparations. Is it fair that the HOA president deemed an emergency and paid for the damages to the unit below me while refusing to declare an emergency in my apartment and refusing to pay for the damages?
