I just found out one of our Board member sold his unit, it closed as of 05/21/12. He didn't notify any other Board Members and planned to attend our Executive meeting tomorrow. When should a member resign in a case like this? We are in the State of CA. Please help!

Look at your governing docs, probably your Bylaws, to see if directors must be owners of record to continue serving (not just to be a candidate for the board).

You need to check your governing documents to see what the requirements for being a member of the board are;

It's also possible he may be intending to submit his resignation at that meeting. Shouldn't you wait to see?

I agree with those who state to check your by-laws or governing docs. Most state that a board member must be a unit owner or spouse of a unit owner. If this is so in your docs, it seems to me your board member is automatically off the board (whether he notifies you or not) as soon as the act of sale is past..unless, of course, he owns another unit.
