Can a home owner become a paid janitor of the building and hasve the right to vote on maintenance issues.

Oops, sorry, Juan; I see the person is a director. Does your HOA have a contract with the janitor? Is he paid hourly? By the job?

It seems to me whether you'd ask him to recuse himself would depend on what kind of maintenance is involved. If it's a task that would benefit him financially, e.g., a job that would require overtime pay or some other benefit, you might not want him to vote. But you may want his participation in discussion.

Seems like we need a little more detail about his job description.

The director who is, or would be, a paid vendor would need recuse himself from voting on maintenance matters in which he possesses a potential or actual financial interest.

That said, check your by-laws on this matter. Many HOAs don't allow directors to be paid for work associated with HOA operations.
