When a management company does not perform its contracted duties in an acceptable and timley manner; What is the best action to take (beside finding a new management company)? Is there a forum for evaluating management companies so other HOA's will be aware of significant performance problems?

Such as: Not paying bills in a timly manner even though cash is available. (Their bills are always paid instantly) Not responding or returning Board Member or Officer calls. Failure to perform maintenance services for 3 months. Failure to post meeting notices. and on and on....

Peter, why exclude changing management companies? That is the best action for unsatisfactory performance. The second best action is to rewrite the management agreement to spell out exactly what duties your HOA desires and the consequences for not doing them. I know of no forum but wish there was an internet location which had the guts to post such info.

I agree with Rogers’s response, 100% this is my first year as a board member and that is the first thing I did was to review the contract we had with our management co. I then started asking questions concerning why they didn’t do this or how they do that.

Our entire board went to the office of our Management co, one afternoon to have them address our questions. We received the answers we needed to know and we are still happily working with them.

We (the board members and I) just needed to know exactly what services were they providing to us.

Some of the questions you should be asking are perhaps of the same questions, a homeowner might ask, if given the same opportunity. Where is my money going toward? I’m sure you have plenty of questions to ask. I would want to address these same questions to the property manger. If they don’t give the answers you and board feels will benefiting the entire community, then drop them! PERIOD.

Be sure to read the contract. Many state a certain time required before discontinuing their services. You definitely would want to review that first.

I’ll admit changing management companies wouldn’t be easy nor would it be my first step, in resolving your present issues, but you definitely don’t want to rule it out.

You may need to gather up the board and call your management Company and speak to your portfolio manager personally and ask him/her what day would be best to discuss your contract. That you are uncertain about how things are done and you and the other board members would like some clarification!

It’s a lot of hard work, but no one ever said being a volunteer board member wasn’t going to hard work, time consuming, etc., etc.)

I hope you take the this option very seriously and make the arrangements to arrange a day when you can receive the clarification your HOA is in need of
