Do you have to join an HOA, if it was not in place when you purchased the lot.

If you mean, a group of people wish to join together to form an HOA and included you in the invitation, no, you do not.

If you mean "no one told me about the HOA when I bought", but it was on the deed, then yes.

If you purchased in a new development it's likely that the Builder performed the duties and fulfilled the obligations of the Association without you even being aware of it. Then when the builder turned those responsibilities over to the owners, you are now hearing about the Association.

As Brian said, to determine if membership in the Association is mandatory or voluntary you will need to check your deed restrictions. These would be filed at the county courthouse if you didn't receive a copy when you purchased your home.

Could you elaborate on what you mean by "it was not in place when you purchased the lot?"

That phrase could mean that there was no association mentioned in the CC&R's or maybe even no CC&R's. Or it could mean that the developer failed to file articles of incorporation for the association until a later date. Maybe it could mean that the association had no officers when you purchased or was not conducting business under its own name. Or it could mean that a group of owners are trying to create an association on their own. Each of those scenarios -- and other possible scenarios -- have different answers.
