Under our present voting statutes for new officers for the coming year we are required to have a quorum of 50% of membership. We use
proxys to try and reach a quorum but fall short of this each year. It seems difficult to reach a quorum as many of the home owners do not
want to be involved. Is there anything we can do to help us reach our voting goal.

Due to apathy in a HOA it's nearly impossible to get the numbers "Required" in the documents to work. It's just not going to happen in most cases. That is the sad and awful truth one must face in their HOA. However, facing that truth often gives the solution. Huh? A HOA is run by it's members for it's members in the way they see fit. Sometimes the rules and regulations can't be met and the members need to work on changing/modifying to make it so they fit. It is all in the documents on how to do this. Just know it can be an expensive and drawn out process to complete.

All this sounding like kind of dreadful and unsurmantible news? Well hold on...I live in the "There's always a BIGGER fish" world. (Yes I stole that from Star Wars...). My advise may be a bit out of the box or out of this world but it can work. It worked for our HOA in the long run. The apathy was so bad I often had meetings in the swimming pool or only one that showed up. This out of 107 homeowners! So I know apathy!!!

I would "buck" the rules a bit. Meaning I wouldn't adhere to that 50% requirement and get those people truly intereseted onto the board. Meet the board member requirements even if it's by who ever shows up at the meeting or puts their name in the hat. Heck, who ever raised their hand at our yearly meeting got elected in at ours. We then picked the positions amongst ourselves on the board.

This will do two things. Meet your board member requirement and tick a few people off who didn't attend/interested. Once the board that was created starts to make the decisions and works through some issues, those apathetic people will come flooding out of the woodwork. I guarantee that. Once that happens or if it does happen, you have got yourself some bigger fish to fry or some of those small fish who eat the dead skin off your feet in those expensive spas...

I would walk door to door with the proxies, explain the issues and ask if they would be willing to assign you as their proxy representative.

You might also want to try a Directed Proxy rather than a general proxy. A Directed proxy instructs the representative to cast votes a specific way. When we started using directed proxies, the proxy count did increase - I suspect members had more confidence that their vote would be cast the way they wanted.

I find the 'advice' to buck this or that or just do it to be very reckless. The issues and statutes regarding your type of living situation are a bit more complicated than others due to the limited ownership possilities.

There is a lot of reliance on the bylaws and less on state statutes in 723 so seek professional advice on the language of your bylaws.

Any efforts not in compliance may result in nothing more than a waste of time so take Tim's advice and canvass the community to get the proxies and work within the specified laws.

Until there is a "HOA Jail" a board or member can be sent to...I say stirring the pot a bit makes apathy go away...
