Our board is not acting in favor of the homeowners. We have told the board this and they are not responding to the homeowners need. We would like to replace the board. How do we do this?????

Are you in a condominium association, a single family home association or a mobile home park association?

Depending on what type of Association, different laws may apply.

The Board must act to fulfill the contractual obligations (trash service, maintaining common area, etc.)the Association is required to provide. They must also act to fulfill the obligations the Association has with the State of FL (annual reports, taxes, insurance requirements, etc.) and the Federal government (taxes). Typically, when the Board fulfills these obligations, they are considered actions in favor of the homeowners/members.

In addition to fulfilling these obligations, the Board is also authorized to enforce the covenants. Depending on the perspective, this may or may not be considered acting in favor of the homeowners.

Why is it you believe the Board is not acting in favor of the homeowners?

First, I'm adding my voice to tim's: What does your Board do or not do that troubles you?

Next, you should be able to find out how to recall the Board in your governing documents. You might start with your Bylaws.

Another option is to wait till your next election and vote for different people to be on the Board.

As a mobile home park your Association is likely subject to Florida Mobile Home Act.

Is your Association incorporated as a co-op or a nonprofit corporation?
If they are, additional laws would apply.

Before we jump to the point this Board needs to be replaced I would be interested in knowing just what does not in "favor of homeowners" mean?

What has occured and what led us to this point?

I would think the members of the Board are also homeowners. So they are working against themselves?

How did they get into their positions? How long have they served? And who out of how many wish to now change the Board and are willing to tkae over and give of their time?

Sounds way to vague for me to weigh in at this point.
