Our HOA recently gave notice that garden flags/bird feeder can not be on the common grounds or else fines will be imposed. I have both outside the fenced area of my patio. While these items are no longer allowed on common grounds bird baths are. (why the ban on somethings and not others I am not sure why) Also windchimes, plants and other decoractive items are allowed to be hung from the patio/deck. If I place flag/feeder on my patio am I in violation?

Typically, most Associations require prior approval for any exterior change. This could include decorative items, etc. Some Associations allow for some decorative items to be placed without approval and some do not. It all depends on what is written within your governing documents and, to be honest, the temperament of the Board/enforcement committee.

Therefore, the best answer would be that you may or may not be in violation.

When in doubt, ask for approval first.

I agree with Tim. The correct answer is in your docs not what we out here think.

As an example in our HOA we all have a small backyard/patio that is fenced in with 6ft privacy fences. One can pretty well do what they want in this space as long as the height of something does not exceed the height of the fence.

Each home also has a small front patio/porch (unfenced) where the restrictions get tighter on what one can do but as long as what they do is in good taste (now that can be a tough one to define), we do not look for issues. Of course if someone complains, then we will have to look at the situation but so far we have had no issues.

My off the top of my head answer is your issue was stuff on common property and your bird feeder will be fine as long as it is on your patio.

I have three bird feeders and love them. I'm betting your board doesn't like the excess waste seed that gets spilled, and builds up, on the ground beneath the feeders. Bird baths wouldn't have this problem.

You need to hire 5 or 6 squirrels to visit regularly. They eagerly volunteer to trespass in my back yard.
