Does anyone know of a website that shows what a Recall Petition looks like and how it should be worded? I would appreciate a link website. Or an attachment to your response will also work. Thanks.

Ralph,

The recall petition is typically a petition for a special meeting for the purpose of recalling xyz Director and the election of new Directors (if the recall is successful). If the petition was worded to just recall the Director vs. to hold a meeting it could be seen by the board as a request.

Davis-Stirling.com has a format but it references CA law. You will need to reference AZ law and/or your Associations governing documents.

Here is an an AZ recall petition used to recall a State elected official. It can at least provide you a format.

Hope this helps,

Tim

Arizona Revised Statute 10-3808 provides for the removal of board members from non-proft corporations. Click here for the text. Note that the statute is only applicable if there are no provisions stated in either the articles of incorporation or the by-laws.
