My mother passed away 3 yrs ago the unit was vacant . We have 60 plus units in our hoa. I'm considering renting, but my hoa only allow 5 rentals. Can they take legal action against me? Can this be inforced?

Read your documents!!! What is the punishment if you choose to rent? You may be surprised they lack actual enforcement/punishment. Most just say rental limits but fail to bring in the violation you will face if you do...It is a loophole...

the answer is, as Melissa pointed out, "it depends".

there is a contract, between the owner of the property and the HOA. that contract spells out what each side can do. You will have to read that contract to see what it says. Does it limit rentals? IF so, how? And what is the penalty for breaking the contract?

bottom line, we can't answer the question without reading it ourselves.
