We are a 900 home community in Georgia, have recently transitioned from the developer and our attorney is recommending that we switch from our current hoa status to poa. Is this the best action for our neighborhood?

Without knowing the advantages and disadvantages between the two it's difficult to say.

If you not on the Board you should ask the board (and if on the Board ask the attorney) to give you a list of the advantages and disadvantages between the two and what laws would be applicable to each. This way you can make an informed decision.

Our Association recently adopted the Georgia POAA. One of the reasons we did this was to strengthen our ability to collect on assessments. You can read about the advantages at Benefits of the Georgia Property Owners Association Act.

This particular law is specifically for Associations in Georgia. To the best of my knowledge, a similar bill was floated in SC a few years ago but was not passed by the legislature.

South Carolina has a Horizontal Propery Act that basically covers apartment type condo associations. They did try and pass a Home Owners Association Act but it got held up in committee several years back and no one is pushing for it.

SC is more interested in passing feel good type stuff then hard laws concerning HOA's.
