We want to add a rule specifying certain parking restrictions. The rule would be further clarification of a restriction so the rule is reasonable.

Questions is, is the language generally generated by an attorney or can we just add the rule and provide a copy to homeowners? I just want to make sure we proceed in a proper fashion.

In many cases adding or changing a rule can be handled by the members of the Board. That is if there is no chance this might cause some legal issue. Parking should be fairly cut and dry. Perhaps if you employ a MC you might ask them for assistance.

IMO this would not require the input from a lawyer.

I agree with Jon that most rules can be written by the members. I also prefer plain language over legalize.

I'd suggest looking at similar rules of other HOA's within your State/County. This can be a good starting point. Then, run a draft by the membership to get their input. After any modifications, if the board is concerned, they can send the draft to the attorney for input (this is also typically less costly then having the attorney write the whole thing).

If your just in need of proper wording, or clairifacation you might seek out a paralegal. We use one at $30.00 per hour, well worth it when you concider the cost of the Lawyer at over $200.00.
