Hello All!

I am a realtor in a southern state, and in addition to that I try and help my younger brother with referrals in his business. I would love some feedback from anyone willing to talk to me about an idea he has for his landscape border business. He and his wife have decided to offer the local hoa's free landscaping borders around the entrances and select other areas of subdivisions and other types of home owner communties if they will allow him to tastefully post his signage near the curbing work after the work is completed. In addition, he will offer for a very limited time, to any and all members the opportunity to purchase his products and services for 1/3 to 1/2 off, if I heard him correctly, in exchange for a bonafide contract to install curbing at the individual's residence.

I guess my question then, is, this: Would he be allowed to do that, or encouraged to, as I know that signage is a big no no for most hoa's, and if there might be some other potential objections to this type of networking/referral system if he pursues this.

I hope I am not considered to be spamming here; that isn't my intent, at all, especially since I haven't disclosed the town or state that we reside in or the name of his business. I just really would like some feedback on it, from the leaders of the associations and the homeowners themselves. Thanks ahead of time for any comments, good or bad, that anyone may have.

Many HOA's prohibit such signs in their CC&R's so they could not be permitted.

An alternative is if the HOA has a web site, then as a realtor you may be able to advertise there and your younger brother may be able to advertise his landscape business there, both for a nominal fee.

There are some HOA's, mine included, that do not have restrictions on signage. I, as a board president, would be open to discussing with you and presenting to our board at a later time. However, I would want to make sure the signage was tasteful and was only up for a specified amount of time. Depending on the area you are located in you might not have any luck finding HOA's like mine. The idea of offering homeowners's a dicount is a good idea, I wouldn't want it to be a mandatory thing as I Want all homeowner's to still have a choice. We have many first time homeowners who don't have the funds or experience with landscaping. Also, our HOA has a small budget and we like to keep our dues lows, I am always looking for good deals. i think your idea has some merit, depending on where you are.

I think the risk here is that by allowing the landscaper to display an advertising sign, it will be difficult to prevent homeowners from displaying signs advertising their businesses.

You could give the company a plug in the newsletter or website in exchange for services.

If you don't have signage restrictions then I wouldn't see that as an issue. The only restriction we have is size, other than that we don't have any.

Is the curbing is considered a common element, replaced by the HOA? If so, multiple bids need to be sought.

Otherwise, if the HOA permits signs, your brother is doing a good thing, hope it proves successful!!
