Hi All,

I am President of a HOA in Georgia. We are a Townhome community of just 20 units. Last night someone backed into one of our neighbors mailboxes and damaged it. We have curb side mailboxes, and even though our covanents list a laundry list of what the HOA is responsible for as far as outside maintenace, it does not specifically mention mailboxes. Is there a general rule or opinion on who is responsible for the mailboxes? HOA or Owner -- or city?

Wendy, the first one responsible is the person who backed into the mailbox. I presume this person is unknown. So based on your post stating it is not mentioned in the CC&Rs, I would presume the HOA should replace it.

i would suggest contacting the post office first. they might know who is responsible.. the feds, the landowner, or the HOA.

Do you have a Reserve Study? Are the mailboxes listed as an item for replacement funding. If they are, then it's the Association's responsiblity to fix the mailbox.
