What exactly is a PLANNED COMMUNITY as it pertains to HOA laws?

Typically its an HOA just like everyone else. If your state has no HOA laws, you will typically follow condo association laws.

Planned Community is generally single family dwelling units vs. Condominium which is buildings with multiple units.

To me a planned "community" is one that was planned on, regulated, and controlled from its inception hence CC&R's, Bylaws, Rules and Regulations, etc. before "unit'" one was sold.

I would not draw the distincion in type of homes. I say a planned community can have single homes, town homes, condos, mobile homes, rentals, retail, strip joints, etc. depending on how wide "spread/diversified" the community was "planned" on being.

Of course, I could be wrong.

Well you do have a good point โ€ฆ I was thinking more of statutes and how titled because some States do reference communities other than Condos as a Planned Community which includes all others except Condominiums as they are generally separate statute sections.

There are States in which they have Condominium Statutes vs. Planned Community, Homeowner Association (HOA), Property Owners Association (POA), Planned Unit Development (PUD), โ€ฆ

As a general rule potentially Condominium is one and Planned Communities are another and which can contain homes, townhomes, mobile homes, etc.

As far as Florida is concerned, whether a community falls under 718, 719, 720, 721, or 723 depends on the Declarations. My condo is in fact a separate, single family home, but is considered a condo and falls under ยง718 because the community's Declarations were set up as COA rather than HOA.

Here are 2 good books for you to have.......
1. The Law of Florida Homeowners Associations, by Dunbar & Dudley, 8th edition (check to see if there is a later edition)
2. New Neighborhoods by Gary & Ryan Poliakoff - gives historical and current perspective of community associations.
