We live in condominiums that were converted from apartments and the HOA is not established yet. We have a "construction office" that said when the complex was 80% sold, we would be informed of a meeting to establish an HOA. But until that time, they are trying to enforce things that have not been brought to any HOA. Can you give me some guidelines as to what types of things can be addressed until an HOA is established? Does a construction office have power to determine policies BEFORE an HOA is established? If you ask any question, they say that needs to go before the HOA. But when they want to make their own rules, they say it is an HOA rule. Help, please??????

Vicki, are you sure the Declaration was not established by the Developer prior to selling the condos? This would establish the HOA and the Board would be controlled by the Developer. I think this is probably the case.

You can check with your County Recorder's Office as to whether the Declarations have been filed, many have web sites and the information is available online.

I don't know. Whenever I ask for information, they say to wait until the HOA is established--Then they will have a meeting where every tenant can attend.
