Can a self-run Board pay a salary to the one member acting as property manager? We are considering changing our governing documents to allow this; however, currently no member of the Board can be paid a salary. This is just an option we are considering!

Nicholas, while it might be legal to hire, as an independent consultant, a member of the Board, I would recommend not doing so. It is an apparent conflict of interest which could be very difficult to explain to the members. I suggest that person resign from the Board if they want to apply for the job as managing agent.

What are this person's qualifications? If Roger lived in your neighborhood maybe it might work, but if it was me then no. As Roger said it is a severe conflict of interest that I would not want to get involved in.

I am currently on our Board and they have asked would I like the job. At first I also thought it would be a definite conflict; however, I have been practically managing the property for six months without even being reimbursed for my expenses. I love being on the Board but I don't know if I would like someone else 'taking care of my home'. It's kind of 'I can do it better myself' type things. Currently I am doing everything for contracts, bids, towing, fines, PO Box, website, e-mail, phone calls, dues, bills, checks, etc... I just want to do what is best for my community.

If you are serious about being the property manager you need to resign from the board. Since the board supervises the property manager that would be a bad situation for you.

I am not to warm on the idea, but if you are qualified, have experience and submit a quality bid and the board hires you, then I guess it could work. I just wouldn't be too keen about supervising a subdivision I lived in, you would have a hard time being objective and unbiased on things.

But, you must resign from the board if you do this, otherwise you are setting yourself up for some big problems later on.
