I live in Florida. Our HOA by-laws state that a person has to have been on the Board of Directors for a minimum of one year before that person could be nominated and elected as President of the HOA. Is this time restriction enforceable for a HOA in Florida?

If your BY LAWS state that then yes they are enforceable by the association......Please go read and print Chapter 720 Florida State Statutes and memorize them as if those documents are the Bible......Please bear in mind that the Statutes use wording such as..." unless the governing documents" so if your HOA has documents that state you must be on the BOD a minimum of one year....Hope this was helpful to you....Linda C

Your community can amend those documents if you feel that the requirement shoudl be waived. I personally think it is a good idea but not always practical, especially in self-managed associations.

This sounds like a HOA specific law. Like the other poster stated, it can be changed if enough interest is generated on this subject. However, that most likely isn't going to happen.
In my HOA you could be elected for Board member even if you were deliquent on your dues. The catch was that you couldn't vote for yourself! You lost your right to vote if you were behind in dues. However, who is going to vote for someone who isn't up to date on their dues?
The president was elected by the voted in board members. They were to "pick the officers". However, we mostly just voted for whoever wanted the position.

Just wondering, how did you ever get your first President after transition? Wouldn't that be a new experience for all elected BOD's.
