Help
We have 59 homes in our Association
Three are already being rented
Is there anything we can do to put a limit on rentals
Our concern is for votes on things that pertain to the neighborhood

I’m new to the HOA discussion scene. I don’t have much advice to give. I think if you supply us with some details pertaining to your particular situation, many of the members of HOATalk will be able to help you out.

Where do you reside at?

Are you self managed?

I’m not sure if your state will allow you to “opt” into POA. I’m now familiarizing myself with POAs (here in Georgia). I’ve learned from many of the posts on this discussion board, that it was available. “Opt” into a POA from an HOA will limit the % of rental properties as well as some other benefits to your community.

Look to your gov. docs. Renters are probably not allowed to cast votes. In my community renters are associate members, only allowed to use the common elements/space. Renters are not allowed to vote, or join the board.

Be careful with putting a limit on rentals. For some owners, renting is a better option than selling the unit at a loss, or a less than desirable profit margin because of a down real estate market. The effect of forcing a percentage of owners to sell rather than rent may have a negative effect on the value of units in your community.

Gerald is correct. Who knows if down the road they might have to rent their home out. What about existing rentals? Would you allow those three to continue as rentals but deny others that right? So who would vote to contain rentals if you will grandfather in just those already renting? (And if containing rentals is not already in your documents, it would need to be approved by the required percent of your members - this is not something the board can implement.)
Actually your contract is with the owner, and you should already have all the tools in your CC&Rs to police the property via the owner.
We have rentals here that no one but immediate neighbors knows are rentals. The owner hires a landscaper to maintain the property - actually better than some neighboring properties. (I assume the cost is tacked onto the rent). Any parking, etc infractions are relayed to the owner to comply or be fined. Owners will not absorb much of that before taking action. Be sure tho, that you are not selectively enforcing your documents against rentals that you aren't enforcing against other homeowners. Harold

If you don't have rules in place to handle renters get them now, while we don't limit the number of renters no lease may be for less than six months time. The Association must be provided with the name and contact information of anyone living there and most importantly the renters must obey our CC&R's. We also make sure that the homeowner is aware that they are responsible for any damage done to Association property by their tenant. Oh yea, we also have the power to initiate eviction proceedings on a tenant and the homeowner has to pay.

Our association is now a year under HO control, so we are still new at this HO stuff but thanks to this forum I am learning every day. We have a TH community (77 units) and I would say we have at least 50% renters. We have NO renter policies and would like very much to add these to our R&R's. How could we go about doing this at this time. Our BOD's do not even know which houses are rented. We also don't know the names of any renter. Is is possible that we can add these policies at this late a date and how would we go about it. How would an association get the authority to evictions.....I would sure like that power, I have renter on each side of my unit, one is the couple w/the sign(s) in the yard, the yard full of cigarette butts and a large commerical vehicle that is parked across the driveway half the time....Did I mention the President lives across the street. We really need help w/these rental problems.

Sidney start with your CC&R's, do they say what is allowed as far as renters or how to amend them what % required to amend, if you already have 50% rental you may be out of luck getting the required votes to amend. If your CC&R's mention rental units you may have the power to set rules governing them, you should talk with an attorney familiar with your States HOA law. As far as the power to start eviction proceedings; it was in the last revamp of Ohio's HOA law and may not be allowed in your State, another question for the attorney.
