My toilet leaked into the unit below me. Since the problem is inside the unit, the Association says that they are not responsible for the repairs. Had it been an emergency, I would have expected the Association to shut off the water to my unit. That would be reasonable. Instead they waited 5 days , hired themselves and a friend to repair the leak ans sent a very large bill to me 32 days later. In my opinion, they acted as an agent for the owner of the unit below mine instead of letting me hire someone to do the work. They of course have keys to my unit. My question is
1. Shouldn't I tell them to collect from the person who hired them?

Most of the time this is not possible. Its likely they would have needed to shutoff the water for the whole building. I've never seen a multi unit with individual shutoffs.

Was this person licensed? If not, is the repair even correct?

Sometimes billing takes time. 32 days isn't unreasonable.

The bill sounds like its yours. If you refuse, the association will just pay the bill, then come after you for the money. They may tack on additional costs trying to collect from you. It was an emergency situation affecting other homeowners.

Fortunately we are getting a little more information with each post. However, it would be easier if you would just keep it all in one thread.

From what I gathered in all the posts:

1) Your toilet leaked and caused damage in the unit below.
2) The owner of the unit below contacted the HOA.
3) It is unclear if you were out of town or unreachable at the time.
4) On September 3rd, the HOA informed you of the problem and that they had done the repair work.
5) Since the problem started in your unit and not with the common pipes, the Association wants you to pay the bill.
6) You believe the bill is too high and don't want to pay it (or at least not pay all of it).

This is my suggestion:

1) Ask for an itemized invoice for the work and a copy of the plumbers license
2) Contact your insurance company and turn the bill over to them (as this is what you have insurance for). Address your concerns about the bill and let the Insurance company deal with it.

It's unlikely that a homeowner's (or similar) policy will pay for a repair to a leaky toilet because it's not a "sudden and catastrophic" loss. Even then, there's usually a deductible.

However, under the liability and property damage provisions, the policy might pay for any damage to the common areas and the unit below.
